PATIENT PASS – TERMS & CONDITIONS / COMPLIANCE STATEMENT

Patient Pass by WellMend Rx (“Patient Pass,” “we,” “our,” or “us”) is a communication and coordination platform designed to facilitate the secure transmission of prescription information between licensed prescribers, patients, and independently operated compounding pharmacies. By using this platform, all users—including prescribers, pharmacies, and patients—agree to the following Terms & Conditions:
Patient Pass Is Not a Pharmacy
Patient Pass Is Not a Pharmacy
Patient Pass is not a pharmacy and does not compound, dispense, manufacture, label, package, or ship medications.
All prescriptions are prepared, filled, and delivered solely by independently licensed partner pharmacies selected by the prescriber or patient.
No Medical Advice or Clinical Decision-Making
Patient Pass does not provide medical advice, diagnosis, treatment, therapeutic recommendations, or clinical judgment.
All medical decisions—including drug selection, dosing, appropriateness, safety, and patient suitability—are the exclusive responsibility of the prescribing provider.
Patient Pass does not evaluate or assume responsibility for the clinical appropriateness of any prescription or treatment plan.
Prescription Transmission Only
Patient Pass acts solely as a secure communication conduit for transmitting prescription-related information between prescribers and pharmacies.
We do not store, alter, redact, or clinically interpret prescription data except as necessary to facilitate transmission in compliance with applicable laws.
No Payment Processing or Financial Transactions
Patient Pass does not collect, process, store, or manage payments for medications or services rendered by any pharmacy.
Patients must pay partner pharmacies directly for any compounded medications or related services.
Independent Partner Pharmacies
All pharmacies participating in the Patient Pass network are independent entities responsible for:

Pricing and billing

Regulatory compliance

Counseling patients as required by law

Ensuring medication quality, stability, and safety
Patient Pass does not assume liability for the acts or omissions of any participating pharmacy.
HIPAA Compliance & Information Security
Patient Pass utilizes secure communication channels designed to comply with applicable HIPAA and privacy standards.
By using the platform, users authorize Patient Pass to securely share necessary information with:

Designated clinical staff involved in the care process
We do not sell or disclose personal health information to third parties.
No Guarantee of Medication Availability or Turnaround Time
Medication availability, processing times, shipping options, and delivery schedules are determined entirely by the pharmacy.
Patient Pass does not guarantee:

Inventory availability
-
Compounding capability
-
Delivery timelines
-
Insurance reimbursement
All fulfillment decisions rest with the pharmacy.
User Responsibilities
Prescribers agree to:

Exercise independent clinical judgment

Ensure accuracy of prescriptions

Comply with all state and federal prescribing regulations

Provide appropriate patient evaluation and follow-up
Patients agree to:

Provide accurate health and demographic information

Communicate directly with pharmacies for billing or medication questions

Follow prescriber directions for medication use
Pharmacies agree to:

Maintain all required state and federal licenses

Follow USP compounding standards

Provide required patient counseling

Verify all prescriptions prior to dispensing
Limitation of Liability
To the fullest extent permitted by law, Patient Pass shall not be liable for:

Errors or omissions in prescriptions submitted by prescribers

Delays, quality issues, or compounding errors by partner pharmacies

Adverse drug reactions or therapeutic outcomes

Misuse or misunderstanding of medications

Shipping delays or carrier-related issues
Users acknowledge that all clinical and dispensing responsibilities rest solely with the prescriber and the dispensing pharmacy.
Modifications
Patient Pass reserves the right to update, modify, or revise these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of any updated terms.
Acceptance of Terms
By accessing or using Patient Pass, all users acknowledge that they have read, understood, and agreed to these Terms & Conditions, and that they will comply with all applicable laws and regulations governing prescription drugs and patient care.
